Update: Charges Against Greg Hardy Dismissed

Drafting Kony Ealy looks like a potential great pick-up now.

Gettleman is psychic.

Greg Hardy is facing legal trouble heading into the stretch before training camp.

The Carolina Panthers' pass rusher was arrested Tuesday on two misdemeanor charges: assault on a female and communicating threats, according to Charlotte-Mecklenburg police. He later was booked into a Mecklenburg County jail and held without bond.

According to a police statement obtained by NFL Media, officers responded Tuesday to a domestic violence assault call at about 4:18 a.m. ET in the 100 block of North Tryon Street. When officers arrived, the victim told them she was physically assaulted and threatened by Hardy. The victim said she has been in a relationship with him since Sept. 2013.

The Panthers released a statement on the matter Tuesday.

"We are very disappointed to learn of the allegations involving Greg and are concerned for all parties as we continue to investigate."

Hardy tied a team record with 15 sacks in 2013 and had 11 in 2012. Those two superb years forced the Panthers to place the franchise tag on Hardy this offseason. He quickly signed the tender, meaning he'll make $13.1 million.

The team can no longer rescind the tag, but both sides have until the July 15 deadline for franchise players to reach terms on long-term deals. It's not clear if the arrest will affect those negotiations.

Yea its lucky we got Ealy but still I am waiting for full details on this situation before I lash Hardy for this situation these things can be murky sometimes. Once they pull the word "suspicion" off the reports and give us a little more detail into what he actually did or didn't do I hold my comments on the situation instead of jumping right into something without the details.

The fact that he was immediately arrested and held without bond is a bad sign, no?

He wasn't arrested until hours after the incident in any case being arrested isn't a good sign but doesn't mean he is guilty just yet either until the court tells us otherwise. If a woman calls the police and says she has been abused they are going to warrant a arrest immediately then do questioning afterwards NC State law in regards to domestic violence once arrested there is a 24 hour cooling down period before they will set bond which is why he stayed in jail over night.

No news is good news so your right about the arrest being bad cause it was headlines but I am not going to say something until I have read a report stating there is evidence and proof for these "alleged" assault and threats made over the phone. I am not defending anyone's actions just would prefer to have facts on the situation before I go throwing someone under the bus.

So far the only things known are she had minor scratches & bruises is that a sign something happen sure, there is also this.

According to an incident report, police responded to a call around 4:18 a.m. Tuesday morning at the 100 block of North Tryon Street. A 24-year-old woman, who said she and Hardy had been in a relationship since September, said Hardy physically assaulted and threatened her, according to the report.

The report states she suffered minor injuries – bruises and scratches – and she refused treatment. Alcohol is listed as an incapacity type for the victim on the report.

I read on another board but couldn't find a source for the quote but it was by a local who saw the news that stated that "WCNC news said she was drunk and uncooperative".

So for now I am holding judgement on Hardy until full facts come out from the court or Hardy confesses to doing it. If Hardy doesn't confess this could turn into just a he said/ she said thing. This so far isn't so cut and dry like the Ray Rice deal. So I am just waiting for facts not defending Hardy or the girl just wanna know the entire situation instead of assuming something is truth just cause the media runs with it and displays it as such when it first happens.

At this point this is largely turning into two drunks doing he said / she said, still trying to figure out why none of this was included in the original police report

Article from Pro Football Talk

Panthers defensive end Greg Hardy is free on $17,000 bond this morning, but has been ordered to stay away from his girlfriend and attend three Alcoholics Anonymous meetings a week after his arrest on domestic violence charges.

According to the Charlotte Observer, Hardy’s attorney said in court this morning that the woman in the case wouldn’t leave Hardy’s apartment early Tuesday morning (around 4:18 a.m.), and that she attacked the 290-pound defensive end, at which point he called 911.

The accuser’s attorney said that his client has injuries from head to toe, saying she went to the emergency room Tuesday and is in a sling with an elbow injury. The arrest warrant charges that Hardy grabbed the woman, threw her to the floor and a tiled bathtub, slammed her against a futon and strangled her.

Panthers team president Danny Morrison said they were still investigating.

And, proving that irony is not dead, there was a previously scheduled breakfast at Bank of America Stadium this morning for Men For Change, an area group that works to stop domestic violence against women and children.

The only thing I would say I wonder how no one questions the whole police report stating minor scratches and bruises and refusing treatment to suddenly being in a sling so I dunno sounds like a bunch or he said / she said.

and article from the Charlotte Observer:

Carolina Panthers Pro Bowl defensive end Greg Hardy had bond set at $15,000 for assault and $2,000 for threats on Wednesday.

The court ruled that Hardy can’t contact the accuser, Nicole Holder, 24, described as his girlfriend, and he must attend three Alcoholics Anonymous meetings each week.

Hardy, 25, was arrested Tuesday on misdemeanor charges of assault on a female and communicating threats following an early-morning dispute with Holder at Hardy’s uptown apartment, according to a Charlotte-Mecklenburg police incident report.

The arrest warrant accuses Hardy of throwing Holder to the floor and into a bathtub, slamming her against a Futon and “strangling” her.

Hardy also said he would kill her, the warrant said, a threat “made in a manner and under circumstances which would cause a reasonable person to believe that the threat was likely to be carried out.”

Mecklenburg District Judge Becky Thorne Tin said that both Hardy and the accuser were intoxicated.

Chris Fialko, Hardy’s attorney, said the accuser was attacking Hardy and a friend and wouldn't leave Hardy's apartment. He said Hardy called 911 when she wouldn’t leave.

Hardy’s agent Drew Rosenhaus declined comment.

Attorney Stephen Goodwin said Holder has injuries from “head to toe.” He said she went to the emergency room. On Wednesday, Holder was at the courthouse with her arm in a sling.

Documents say Hardy and Holder had been dating since last September. She is a waitress at an EpiCentre restaurant.

Hardy was booked Tuesday afternoon when he turned himself in to police, according to a police statement.

According to the incident report, police responded to a call around 4:18 a.m. Tuesday at Ivey’s, an upscale condominium building in the 100 block of North Tryon Street. The woman, who told police she and Hardy had been in a relationship since September, said Hardy physically assaulted and threatened her, according to the report.

The report states she suffered minor injuries – bruises and scratches – and she refused treatment. The report says she had been drinking alcohol.

“We are very disappointed to learn of the allegations involving Greg and are concerned for all parties as we continue to investigate,” the Panthers said Tuesday in a statement.

Wednesday, Panthers president Danny Morrison said there's no update on the Hardy case and the Panthers are still investigating.

As the Panthers were preparing to make Hardy one of the team’s highest-paid players this offseason, there were concerns among team officials about Hardy’s off-the-field behavior. Those concerns had followed Hardy since college at Mississippi, but until Tuesday, Hardy’s criminal record included only traffic violations.

Hardy was jailed overnight Tuesday. A sheriff’s office spokeswoman said it’s typical in domestic violence cases for suspects to be denied bond for at least a 24-hour “cooling-off period.”

After Hardy, who is 6-foot-4 and 290 pounds, tied a Carolina franchise record with 15 sacks last season and went to his first Pro Bowl, the Panthers placed the franchise tag on him, a designation under the NFL’s collective bargaining agreement that guarantees him a contract worth $13.1 million this season.

The Panthers said in February they would continue to work with Hardy on a long-term deal, although there have been no indications the two sides are close to an agreement.

Carolina agreed recently to give Hardy as much as $1.3 million – 10 percent of his franchise tag contract – if he attends all of the team’s voluntary offseason workouts, which are ongoing.

The Panthers have long been an organization with a heightened concern for their players’ off-the-field issues, and that is no different for Hardy as he negotiates a long-term second contract.

Hardy, who transforms into his alter ego “the Kraken” on the field, has had several off-the-field incidents that have troubled the Panthers, though this is his first known arrest.

The Panthers selected Hardy in the sixth round of the 2010 draft after the defensive end, considered an early- to mid-round pick, fell down teams’ draft boards because of character questions. He was suspended for two games at the University of Mississippi after missing team meetings and violating team rules.

Hardy told Sports Illustrated he was kicked off the team but was later reinstated.

Tyrone Nix, former defensive coordinator at Mississippi, told the Observer that Hardy never had any incidents involving violence toward women in college.

“It surprises me,” Nix said of the charges. “I’m sure the truth will come out in the end. And Greg has always been a guy of high character, as far as respect to others.”

In 2011, Hardy was involved in a motorcycle accident that left him with a concussion and severe abrasions and kept him out of most of the Panthers’ preseason activities. The following summer, he tweeted a photo of a Bentley speedometer that appeared to show he was driving more than 100 mph.

He was benched for the start of Carolina’s Week 13 win against Tampa Bay in 2013 after he was late to a team meeting. Hardy was fined by the team and apologized to coach Ron Rivera.

Hardy’s prior criminal record consists of traffic violations. Charges of no operator’s license, a window tinting violation and driving without registration were dismissed in 2011. Hardy was charged with speeding in July 2011, going 86 mph in a 65 mph zone. That charge was lowered to 74 mph and waived by the clerk.

In October 2012, Hardy was charged with going 54 mph in a 35 mph zone. He received a prayer for judgment. A third speeding charge came in November 2013 when he was charged with doing 52 mph in a 35 mph zone. That charge was reduced to 40 mph and the charge was waived in March.

Her accusations are so drastic that they can't be ignored, but why on Earth would he do those things to her, then be the one to call the authorities?

Such a confusing situation. This is something where we'll never know what actually happened.

Is Hardy in a Big Ben getting extorted type of situation, or is he psychotic? We'll have to see.

My GUESS is before it is all over it will be ruled that both parties were drunk, she sometime in the night fell down (whose fault will probably never be determined) and that he will not be guilty of domestic violence simply because of the lack of evidence. What really happened will probably never be publicly known.

Domestic violence is a bad thing, but too many times it gets totally thrown on the man when the woman was the one who was at fault and the man was just trying to defend himself (NOT saying that is the case here but just saying that it happens more than many people would think).

A request for a temporary restraining order against Carolina Panthers defensive end Greg Hardy was dismissed by Judge Charlotte Brown on Thursday when his accuser failed to appear at a civil hearing in Charlotte.
But a short time later, Judge Becky Thorne Tin, the judge who presided over Hardy’s bond hearing Wednesday on two misdemeanor charges, amended the conditions of the bond. requiring Hardy to turn over all of his weapons and firearms.
That is part of what Nicole Holder, 24, had requested in the restraining order she had sought against the Carolina Panthers’ All-Pro defensive end. She also wanted him barred from her home, the uptown complex where she works, and the home of her parents in an adjacent county.
Holder’s attorney, Stephen Goodwin, was present at Thursday’s hearing, but Holder was not.
Goodwin said Holder would no longer be his client, by their joint decision. He cited irreconcilable differences with Holder as the reason, and wouldn’t say if Holder had retained other counsel.
Goodwin said this is the first time since 1996 he has withdrawn from representing a client.
The criminal case against Hardy, regarding the two misdemeanors including assault on a female, will continue. Goodwin would not say where Holder stands regarding the criminal case.
Hardy was not present at the hearing in front of Brown.
Holder, who says she has been in a relationship with the 6-foot-4, 290-pound Hardy since September, filed for the retraining order Wednesday, one day after arrest warrants say Hardy assaulted her and threatened to kill her.
According to Holder’s protective order complaint, released Thursday, she stated that Hardy was angry with her because of a short-lived relationship with the rapper Nelly, who is a part-owner of the Charlotte Bobcats.
She stated in the court documents that she and Hardy had been trying to work things out and that she and Hardy were in bed together early Tuesday morning when Hardy “just snapped.”
Holder, a waitress at an EpiCentre restaurant uptown, had also asked the court to block Hardy from buying more weapons and seize the ones he has. In court documents, she states that Hardy has “25 to 30” firearms at his two Charlotte residences.
Hardy was arrested Tuesday on misdemeanor charges of assaulting a female and communicating threats. He was released on $17,000 bond Wednesday after a short court hearing in which he was ordered to stay away from Holder and attend three Alcoholics Anonymous meetings a week.
Both Hardy and Holder were intoxicated at the time of the incident, according to the judge.
Hardy’s attorney, Chris Fialko of Charlotte, said his client is innocent, and that Holder set off the Tuesday morning fracas in Hardy’s uptown condo by attacking the player and a friend, Sammy Curtis.
Wednesday afternoon, Panthers fans and a national audience began listening to a series of 911 tapes connected to the case. In one, a heavily breathing Hardy describes Holder as out of control, intoxicated and trying to attack him with the heel of her shoe.
“Like, yo, she’s out of it, my man,” Hardy tells the 911 operator. “And she will not stop coming at me, bro.”
In another call, apparently made from the security desk of Hardy’s building, a woman who claims to have attended the gathering at Hardy’s home yells that a woman had been beaten there for more than 30 minutes.
“We need the police here now before this girl gets seriously hurt. Now!” she said.
Wednesday morning in a Mecklenburg County courtroom, District Court Judge Tin said Holder’s injuries and the nature of the allegations against Hardy “raise concerns” about Holder’s safety.
Arrest warrants accuse Hardy of throwing the 24-year-old Holder to the floor and into a bathtub, slamming her against a futon and “strangling” her during an argument at his home.
Hardy also said he would kill her, the warrant stated, a threat “made in a manner and under circumstances which would cause a reasonable person to believe that the threat was likely to be carried out.”
At one point during their struggle, she said in her complaint, Hardy picked her up and threw her into a tub, then dragged her across the floor by her hair. As Hardy screamed threats, Holder said he lifted her over his head and threw her on a couch “covered in assault rifles and/or shotguns.”
She said Hardy keeps a cache of 25-30 “AK-47s, automatic-looking weapons, shotguns, rifles and pistols” in his North Tryon condo and a former residence.
Holder said Hardy threatened to shoot her if “I went to the media or reported his assaults to anyone,” according to her complaint.
Police did not mention guns in either of the arrest warrants. North Carolina law requires permits for handgun purchases, which are good for five years. Buyers can obtain up to three permits with a single application. Each permit is good for one handgun or up to five long guns.
A league source said the Panthers, who are scheduled to pay Hardy $13.1 million for the coming season, met with the player and his agent, Drew Rosenhaus, on Wednesday to discuss the arrest. Rosenhaus, who attended Hardy’s court hearing, declined comment as he left the courthouse.
Earlier that day, while Hardy was still in jail, his team dealt with the irony of hosting a domestic violence awareness rally in the very stadium in which Hardy has starred.

More from the case the girlfriend is switching attorneys so never a good sign for her when her attorney walks out on a case but more added to the plot of her claims though

Greg Hardy didn’t get a contract today, but he did get a conviction.

According Bill Voth of Black and Blue Review, Hardy was found guilty on both counts of assault on a female and communicating threats.

Judge Becky Thorne Tin sided with the testimony provided by Hardy’s accuser during the 10-hour trial, even though Nicole Holder admitted cocaine use the night of the incident.

He was given a 60-day suspended sentence, and 18 months of probation. He’ll appeal to get to a jury trial.

The Panthers defensive end will be subject to punishment from the league under the personal conduct policy.

The Panthers used the franchise tag on him, and are hooked to his $13.1 million salary. But they obviously weren’t working on a long-term extension prior to today’s deadline, since agent Drew Rosenhaus sat with Hardy throughout the day’s proceedings.

Her testimony is compromised is the point. She has no evidence that Hardy did anything, to my knowledge.

If he beat a woman, he should be gone, and good riddance. Just thinking that this all seems a bit weird.

Stuff like this, for example:

Hardy’s accuser admitted to using cocaine the night of the attack, and when defense attorneys asked her about a previous car accident she was in in which police found marijuana on the scene, she replied: “The weed flew out of my car.”

And when defense attorneys asked Holder how she came through an assault from a player the size of Hardy “without breaking a fingernail,” she replied: “Uh, I did break a fingernail, a toenail.”

She doesn't keep her story straight, either. Something happened, sure, but she was drunk and using cocaine during the night she alleges Hardy assaulted her. Red flags all over the place to me.

Go listen to the 911 call too. She is screaming to get back INTO his apartment. That does not add up at all.

Yeah its a pretty messed up ruling, I followed the tweets live all day long as they came out and this judge had her mind made up well before this case. It was a very biased judge who basically had the 10 hour trial for show for the public. I am glad it is going to a jury trial. As for Holder she testified this wasn't about money then moments after the ruling her and her lawyer stated they were going to go after Hardy's money to the media which basically shows her ultimate goal is what everyone thought from the start.

The sad thing about this given our past with Carruth and Mr. Richardson's no tolerance past on these situations keeping Hardy long term is probably out the door after this year now. They said it could be after the season before they even have the jury trial. Unless they feel like the general portion of the public and wait this out because they can't believe the ruling either. Most teams would try to give the guy the help he needed including on a first offense heck the Ravens are sticking it out with Rice with video evidence but that has never been a thing with this organization they like to get as far away as possible from anyone with this kinda rep following them even if this does get dismissed.

I am hoping cool heads prevail and they wait until the jury trial is over with and they decide then if they should pursue keeping Hardy or not. I would say if he stayed he may come at a cheaper rate now given the circumstances and problems this has caused. I don't believe he would be able to ask for a contract the size of one he did before but we probably will never see that happen knowing how they usually handle these things.

Anyways this ruling had BS written all over it including if you go back and read all of the tweets and all of the statements made. There were police who said she tried to flee the scene, she was clutching her purse pretty hard noted by cops (which probably had cocaine in it), security at the Epicenter noted seeing her going nuts on Hardy verbally bashing him in public because he wouldn't take her home with him, they had video of her leaving the apartment and she didn't leave like she was in any hurry they said she casually left. The person that the the judge said was the most credible witness couldn't even decide if she heard or seen anything and admitted she had done cocaine and was drunk.

So much was messed up with the way this was handled, now even ESPN's Ashley Fox has a article out saying the NFL needs to suspend Hardy now and a big piece neglecting the stuff that came out in this trial trying to act like she is standing up for women everywhere. This situation is really messed up including when the general public sees the problem with this ruling. I have read several comments under the articles on ESPN, NFL agreeing that this ruling was messed up from non homer fans.

It sounds like a case of a bitch being obnoxious and probably over the top belligerent. If you've ever been drunk with other people that are drunk, then you know things can go sideways on occasion. Even the most annoying, boundary over-stepping slut deserves to not have a man put his hands on her. It sounds to me like she just wouldn't quit and Hardy possibly snapped, improperly handling the situation.

Obviously, I wasn't there and couldn't possibly know for sure what happened, but that's the way it looks on paper. What she was on might have made her even more belligerent than usual, but it doesn't compromise her testimony. This dude doesn't get a pass just because he's a football player and has never been arrested before. I'm willing to bet that most of the people on this sight, in this thread, etc. break laws on a regular basis and never get in trouble for them. Does that mean that they didn't happen? If a tree falls in the woods, whether or not it makes a sound doesn't matter. It still falls.

How is this a messed up ruling, exactly? He got his entire sentence suspended. Oh no, a little probation. If you or I got convicted for fucking up some female, how do you think sentencing would play out? As far as I'm concerned, if what he's been convicted of is true (it's not just accused anymore: convicted) then he got off decidedly easy.

Of these non homer fans, how many of them were in the court room? At the party? Look, I'm all for waiting for the truth to come out, reserving judgement until it plays out in court, and everything else, but it HAS played out in court. As far as the law is concerned, the truth HAS come out.

It seems like anymore, any time there's a male vs. female dispute that goes public it's, "lolDumb bitch extorting my DUDE!" Ben, Kobe, Hardy, etc... Then when the court says not guilty everyone hails the system for working: until one guy is found guilty. Now the system is a joke. For the record, I'm not here to have a debate over the moving parts in the American justice system.

My point is that I understand why a lot of women don't wanna come forward in certain situations. Look at our reaction when they do.
