DOJ and Supreme Court pave the way to deport homeschooling family

Recommended Posts

Bit of background on this case.

The Romeikes came to America from Germany because Germany apparently has outlawed homeschooling. I was homeschooled myself for the vast majority of my schooling days, so this case hits a bit close to home, especially the language used by the DOJ and the Attorney General that says they are "allowing" people to homeschool, and one letter from the AG flat out says homeschooling is a privilege, not a right.

And privileges can be taken away by the government.

Something to note is that the law that allows the German government to interfere as broadly as they do was, according to Judge Burman, enacted in 1938 by the regime of one Adolf Hitler. It was specifically designed to prevent parents from interfering with state control of their children, which is essentially Germany's reasoning here- they don't "want a parallel society" springing up.

So anywho, here is a list of what has happened to the Romeikes because they want to homeschool their children.

Oct. 9, 2006: Romeikes get a letter from the major saying they will be fined $45/day per child and if necessary the government will use force. The letter is ignored.

Oct. 20, 2006: Two armed police officers come to their house and force the three children who are of schooling age to go to school. This is completely against the laws even of Germany, they had no right to do this. The Romeikes were unaware of this fact at the time, and let their children be taken to school, though they took them back home at lunch time.

Oct. 23, 2006: Police appear again in force to take the children to school. However, the neighborhood had been alerted by the Romeikes and people physically blocked the police from taking the children.

There is a lull where the government backs off, as they are unsure what to do.

December, 2006: Government sends another letter saying the children must attend school, along with a fine of $672 initially with warnings that this would increase in the future if they continued to resist.

The letter goes on to threaten that if they resist for a long period of time, they will lose custody of their children. The Romeikes went to court and tried to explain the situation. The judge in charge of the case refused to see homeschooling as school and found them guilty of not sending their children to school, which is a crime.

The Romeikes continued trying legal means for months afterward, but received no help. Finally, after having paid 7,000 Euros in fines, they fled the country, claiming religious persecution.

The DOJ started looking into their case and began actively trying to deport them. The first judge, Burman, upheld the Romeikes case, and this was then appealed by the government to the Immigration Board of Appeal which reversed the decision and the Supreme Court has now refused to hear it.

Another case, just to show you how far gone Germany is on this matter, is that of Melissa Vusekros. Her parents also kept her out of school, and she was treated by the Germans as if she had an actual psychiatric condition that caused her to have an unwarranted fear of school. She was literally placed in an asylum for the mentally ill and tested because her parents didn't want her to go to public school. In Judge Burman's own words, "this is frankly reminiscent of the Soviet Union treating political opposition as a psychiatric problem, not only a human rights violation, it is a misuse of the psychiatric profession...."

So all the immigrants here illegally and the government goes after any state trying to do something about that on their own since the Feds have failed miserably at it. But a family who can support themselves and wants to come here legally is going to be deported because the DOJ, and I assume Mr. Obama, doesn't want to basically accuse Germany of a human rights violation, even though that is exactly what is going on here.
