Turry 755 Posted October 13, 2013 According to ESPN's Adam Schefter, the 49ers are not counting on OLB Aldon Smith returning to the team this season. Smith has two off-field issues to deal with right now. He's in rehab for alcohol abuse, and he's also facing three felony charges for possession for assault weapons. The Niners are more than capable of playing well defensively without him, but not having him in the playoffs against elite offenses is going to sting sharply. Smith was away from the team for five weeks as he sought treatment for substance abuse. He apparently kept himself in good shape, as he went through Tuesday's conditioning work without issue. The Niners are expected to use their All-Pro pass rusher in Sunday's game against Carolina, likely off the bench behind Dan Skuta/Corey Lemonier. Smith will be back with the starters by Week 11. I don't recall Smith having been part of the NFL substance abuse program. If he wasn't already, there would be no suspension to apply. By definition, his DUI would be considered cause under the behavioral clause to enter him as a Stage one participant in the NFL intervention program. As such, he cannot be suspended as a result. Because he is an entrant under the behavioral clause AND required specific clinical intervention or treatment, he is automatically enrolled as a Stage two participant. He will remain as a Stage two participant for a period no less than 24 months. He will be subject to additional testing (not to exceed 10 tests in a calendar month) and his first violation (Failure to comply) will result in a 4 game ban. His second will result in a 6 game ban. Failure to comply is either a positive test, or a failure to cooperate with his clinical treatment/evaluation. If he can manage the 24 month period without 2 Failure to comply incidents, he is unenrolled in the program and is treated as any other player who never participated. It gives Smith an opportunity to not only ease back in, but stay fresh and rush the quarterback like he's been shot from a cannon whenever he's in the game. Listen NFL Media Insider Ian Rapoport reported Thursday on "NFL Total Access" that the 49ers do not plan to cut Smith, who has $3 million in guaranteed salary next season. That doesn't come close to solving Smith's problems, however. Rapoport said a suspension at the start of the season is likely, per sources involved in the situation, though it's unknown how many games it will last. Significant legal issues represent another hurdle to getting back on the field. Smith is facing three felony gun charges as well as a DUI charge that led to a rehab stay last year. He'll face those charges in one trial set to begin on April 29. Smith's arrest for the false report of a bomb threat came after the judge in his upcoming trial warned Smith to keep his nose clean. "It is possible Aldon Smith isn't on the field because he may be in jail," Rapoport said Thursday. It's a sobering thought for Smith and the entire 49ers organization. But he has gotten the closest thing possible to no jail time. According to Tracy Kaplan of the San Jose Mercury News, a judge has sentenced 49ers linebacker Aldon Smith to 12 days in jail on gun and DUI charges. He gets credit for one day served, and he’ll serve the remaining 11 by participating in a work crew on Mondays, starting July 28. It means that he’ll typically miss one day of work each week until the 11 days are served, exposing Smith to a fine from the 49ers. The bigger consequence as it relates to Smith’s job comes from the decision to reduce the three weapons charges from felonies to misdemeanors. That gives the outcome far less sting, from a legal standpoint. He’ll also serve 235 hours of community service and pay a $2,000 fine. Smith will be placed on three years of probation, during which time he can’t own a weapon or ammunition. The NFL will now review the case for discipline under the personal-conduct policy. Given his history of off-field issues, a suspension is probable. The reduction of the felonies to misdemeanors could help minimize or even eliminate the suspension. BLUE 1,026 Posted August 8, 2014 Per Rotoworld.com: CSN Bay Area's Matt Maiocco reports the 49ers are "bracing" for a 6-8 game suspension for OLB Aldon Smith. A 6-8 game ban would be a bit longer than expected, as most observers have been anticipating a 4-6 game penalty. Smith was in New York meeting with Roger Goodell on Thursday. Maiocco reports the 49ers "do not know" Goodell's verdict yet, but it does sound like Smith's camp emerged from the meeting under the impression that Smith could miss as much as half the season. The 49ers have a Week 8 bye, so Smith won't be available until Week 11. As San Francisco has already lost ILB Navorro Bowman (ACL, MCL) and NT Glenn Dorsey (torn biceps), it's fair to wonder if the team will be forced to play more aggressive offense in Colin Kaepernick's second year as a starter. Smith's ban turned out to be even longer than expected, but it's a fair punishment regardless following Smith's array of off-field transgressions. The 49ers will turn to special teams type Dan Skuta and sophomore Corey Lemonier opposite Ahmad Brooks. It's an enormous downgrade in pass-rush ability. As of right now, Smith isn't eligible to return until Week 11 against the Giants. But the league office is considering lowering the ban by one or two games, which surely would infuriate the Rams (Week 9 opponent) and Saints (Week 10). There is a precedent for reducing suspensions, namely in the form of Ben Roethlisberger and Brandon Marshall. The 49ers are on a bye this week.
